TheMillionDollatTagCloud.com Terms of Services Definitions A tag is a keyword associated to a title and an URL (the address of a web page). The tag is displayd in the form of a link to the associated web page. The tagcloud is the depiction of a group of tags. This tagcloud can be displayed on the homepage of TheMillionDollarTagCloud, or anywhere else. A publisher is a party displaying a tagcloud on its web property. A click occurs when a visitor clicks on a tag and as such follows the link to the tag's URL. Is considered a click fraud the act of generating clicks in an automated way. Tag owners are those companies who decided to buy a tag for a price they fix, and define its title and URL. TheMillionDollarTagCloud.com is also available at tmdtc.com, and can be refered to in this document as TMDTC. About tags - Tags are defined by the buyer: keyword, title and destination URL are determined by the buyer. The buyer can also choose the fore- and background color used when displaying the tag. - The price at which a tag is acquired is set by the buyer, with a minimum of 1$ (USD) - One tag can have only one owner at a time - Tags are case-insensitive, ie TaG is the same as TAG - Tags don't have spaces or ampersands (&) in them - The maximum length for a tag is 16 characters - The tags are displayed in a tagcloud. - Tags should not be offensive, and tmdtc.com retains the right to refuse or remove any tag at any time. In this last case, the buyer will be reimbursed the amount paid for the purchase of the tag. About the tagcloud - A tagcloud is displayed on http://tmdtc.com and http://themilliondollartagcloud.com - It is possible to third parties to display a tagcloud on their website - A tagcloud does not necessarily display all tags, but may display only a random selection. - The most expensive tag of a tagcloud is displayed as the biggest, and all other tags have their size set relative to the biggest one. - People doing click fraud will be definitively banned. About publishers - Users can publish the tagcloud on their website. To have clicks on tagclouds they publish assigned to them, publishers have to register on the website and integrate the tagcloud on their website as described. About clicks - People who register on the website can have their clicks assigned to their account. - To have a click assigned to his/her account, the user has to be logged in on http://tmdtc.com with the browser in which the click occurs. Competition - This competition is free and does not require any purchase of any kind. The only requirement is to create an account at http://tmdtc.com - If tags sold amount to 1.000.000$ (USD) on or before 1 june 2010, 100.000$ (USD) will be distributed to one publisher and/or one clicker. - If tags sold don't amount to 1.000.000$ (USD) on or before 1 june 2010, no draw will be held. According to interest, the deadline may be prolonged, or the contest may be cancelled. In case of cancellation, no compensation of any kind can be awarded to participants (tag owners, clickers or publishers). - For publishers and clickers, one click linked to their account is one chance to win the price. - Owning a tag has no influence on the competition. - A draw will determine the winner. This draw will be held in front of a watchman who will guarantee the fairness of the draw. The draw consists of identifying one winning click randomly with a computer program whose source code will be published. If the click is linke to both a publisher and a clicker, each will receive 50.000$. If it is linked to only a publisher (respectively a clicker), this account will receive the 100.000$. If the click is linked to no publisher and no clicker, a new click will be randomly selected and the procedure repeated until the 100.000$ prize is awarded. - Intermediate competition may be organised, possibly based on points collected by participants. A click on a tag is 1 point. A visit generated on the website through the user's personal URL awards him 2 points. A new registration coming through a user's URL is worth 10 points (+10% of this user's clicks on tags). Points are counted by tmdtc.com's software. If bugs are discovered in the software, tmdtc.com will work diligently to correct these, but the contests cannot be cancelled, and points collected by users can't be increased manually to compensate for any points that might not have been counted due to a bug. General - These terms can be adapted at any time. If participants don't agree with the changes, they can step out of the game, but no compensation can be awarded for generated clicks. - Belgian juridiction is applicable - Any dispute between the tmdtc.com and a tag owner, a publisher or a clicker regarding the interpretation general conditions shall be submitted, failing friendly settlement between the parties, to arbitration by a belgian judge in the court of Brussels. - Tmdtc.com can not be held responsible of any damage you might encounter by participating as a tag owner, as tag cloud publisher or as tag clicker. - All communications, including complaints, can be sent to tag@themilliondollartagcloud.com
